The Somalis have been subdivided for a very long time let's say from the 80" in clans- communities which are fighting each other for the political and economical supremacy of their own country.The word citizenship or the one I usually use of people-citizens of a country called Somalia have been abolished in our vocabulary for a very long time.Who had this "heinous" idea to subdivide the Somalis? Somalis being only one tribe with the same (language and culture,Religion) instead of the numerous Tribes who vie for power and economic empowerment in other African countries they have to find other Achilles heels for the Somalis.The week spot is the famous clan culture which has predominated our political thinking and social thinking.It has its good side when is made of pride and cultural diversity and the uniqueness of the Somalis in Africa and the Arab world but it is easily manipulated by the Ethiopians and Al-ttixad political movement from almost the 80". Today the Somalis are fed with lies that the only way their Clan can survive and prosper is to have its own Clan enclave and subdivide Somalia in Mini-clan enclaves under the hegemony of Ethiopia-IGAD. Some of our warlords and puppet leaders they started to believe and practice this agenda from the 90' for opportunistic reasons and we arrived at the point that every month or fortnight they go for consultation to Addis-Abeba or Nairobi. Some they said in public that the Somalis are not brothers and sisters but only different groups which can only be United in a Confederation of Enclaves of clan-communities.That is the Agenda of so-called leaders like Farole(regions of Puntland) and Mr.Silanyo( regions of somaliland). Now the Ethiopia-IGAD group have added to the list the self-proclaimed regions of Jubbaland which is under the protection(?) of the Kenya army and New police militia from Ethiopia.In Jubbaland regions the Kenya army is only in the lower Jubba the other regions are almost entirely under Al-Shabaab and some parts of Gedo are under the Somali federal government.How the Kenya army under Amisom can contravene to the UN mandate for the African troops stationed in Somalia? WHY the Ethiopians are still holding to their dreams to subdivide Somalia in mini-clan-enclaves?Its simple . They made a long standing secret deals with Big oil companies like Total Oil of France,ENI of Italy and the Chinese Oil giants called China National Oil Corporation. Secondly the Ethiopians have told themselves that to subjugate the Somali regions of Ethiopia( one third of that country)they also need to subjugate The Somalis of the Somali Republic.In that regions of Ethiopia inhabited by the Somalis there one of the biggest reserves of Oil and gas in the world which have never been exploited but explored by the Americans from the 50".Some years ago the Ethiopians gave new rights to explore to Chinese companies but it backfired when the Ogaden National liberation Front- a separatist group- fought against the Chinese. The Tigre Regime of Ethiopia would not like and have not any plans to give those Somali communities their right share in the royalties from the future profits of the exploitation of that resources.Therefore to succeed in their plans they need to subdivide and subjugate Somalia and its people-citizens.They are also are planning to change the Colonial Borders of Somalia by making new sovereign states within the Somali borders. This was the game plan of Minghiste and Meles Zenawi for the Horn of Africa and supported by European Union.and the Chinese government. The Regional states and in particular the Ethiopia-IGAD group are making a big mistake that the Somalis will ever be subdivided in Clan-enclaves. Their alliance with the Al-ittixad business cartels will backfire.because this Somali-Salafist groups have their own separate agendas of financing global Jihad and their alliance with Ethiopia-IGAD is temporary.. Another point is the Somalis cannot be losers and manipulated for ever and may came the day that they will say no as already is trying the government in Mogadishu..For Everybody is good to have a Somalia which is at peace with the region and a nation-State where the Rule of the law and democracy is practiced, which is sovereign for its own affairs.Wait and see.

Its good news that the international community specially U.K has got interested on Somalia from the Business side and investments.First let me make a short comment/ analysis on the last meeting for business and investments for Somalia.It looks to me the British and the Turks are moving fast to embrace what I call the Al- Ittixad Business cartels/Monopolies and their associates which are even part and parcel of Organized crimes/Drug-dealers groups.For the last twenty two years a group of Salafist business groups have monopolized the Somali Republic economy from agriculture to import/export trade.telecommunications.energy,banks like Hawilad and expanded themselves to the east-Africa and south-central Africa.Some of them have links with organized crimes/drug-dealers and reinvested/Laundered the profits in legal business in East Africa.Somalia etc.All this assets and Cash money is where Al-Shabaab used to get their finances and support.With the increased involvement of the Ethiopia-IGAD group this group accepted a new status in which they controlled the Business arenas as monopolistic groups and the puppet Leaders made by Ethiopia-IGAD will control the public spheres of satellites so-called regional autonomous states(with new sovereignty). That deal has been subverted/changed by the new politics of the Somali federal government and the massive recognition of the U.S and U.K and the Republic of Turkey plus the Qatar,Saudi Arabia,Egypt Arab states.Now this groups are divided themselves in two or maybe three groups.One who is still committed to the Original Agenda of assisting Al-shabaab and have a Salafist Emirates( confederation) in Somalia.The second group is in the middle,recognizes the new change and new opportunities for their capitalistic Agendas but is still favorable for Confederate system between Somali clans- communities with the Ethiopia-IGAD hegemony. There is a third group which is totally favorable to having a Somali National federal system but they are in the minority and are afraid of the big Salafist conglomerates which are in the second category.All of them have one characteristic their money and capital is hidden from public scrutiny and national and international accountability.They all need international recognition and acceptance in the international monetary systems and capitalistic systems.They have one recognition till know that of the Republic of China to whom they are linked strongly as a trade country and as a politically ally in their Salafist Agenda for Somalia( including the regions of Somaliland and Puntland).Business and investment do not work in the vacuum or in a failed states like Somalia. That is the reasons they emigrated to east- Africa,South- central Africa,South Sudan and Dubai where there are legal systems who can protect their ill gotten money and investments.Now they need to play this new game on which there is a new Somalia supported by the international community. IF we are to make investments in Somalia we need first and foremost laws who can protect this new capital investments and the rights of the people-citizens to be part of the exploitation of the Somali national resources. Before anything we need functioning Police and Judiciary and after that that laws who regulate Land ownership in Agriculture,,real estate ownership,Industrial ownership, foreign and even Somali investments laws,Laws who regulate a real economic infrastructure where every Somali would get the opportunity to flourish as business and entrepreneur. Now as we stand a small clique which is less than 1% of the overall population controls in an illegitimate way all the national resources and they are the ones who have been invited in London and are the one also the Turkish government is courting..I believe this groups must be involved in the economy because they are the real people who control the economy but we must be careful in empowering them before all the laws protecting the Somali national resources are in place and we must be also be careful of their real agendas and intentions for the future of the Somali Nation.If in this climate this groups convince the President and his government and the international community that they take over all the economic sectors without a State sectors in Oil and gas and main Utilities like Energy,Water ,Education,health we are going for a future disaster and new monopolistic structures who will control all the spheres of the economy and politics.This are Salafist people who all this years have conspired and projected their own agendas and made alliances with regional powers and global ones like China,Iran,France,Italy,Russia,Malaysia and would like to subjugate the people-citizens for a very long time. We do not have to run we must go slowly and make a real legal- economic infrastructure in which those who are interested in the development of Somali-Nation state are protected and nurtured.Wait and see

Its quasi reasonable analysis of the Turkey role in Somalia. What I know is our friends Turkey one time has close contacts and business dealings Al-Ittixad business cartels which are allied with Ethiopia and Al-Shabaab. Somali politics
is very complicated for those which are new comers and at first-sight if you think in black and white you will never understand it. Myself who has being involved in it for a very long time as a human rights lawyer and activist and lately as a blogger it took me a very long time to understand it and came to know how the Islamist of Al-Ittixad business cartels could be allied with States like Ethiopia, China, Iran, and France. First was about the hegemony of Ethiopia of the Somali territories but it became from the 90’ about the Oil and Gas of Somalia. For this reasons atheist State like China and Islamist-radicals like All-Ittixad business cartels are allied. The masterminds of this alliance were Somali elites warlords-drug-barons linked to All-Ittixad political movement and in the same time members of the so-called movement-oppositions based in Ethiopia in the late
80".Later during the first conference for Somalia to reestablish a transitional government in Nairobi from 2004 the alliances was remade
and strengthened including some”‘Ruling elites" of IGAD( Ethiopia,Uganda,Kenya,Tanzania,Sudan, Professional Elites in politics, business, professionals in media-print and TV and Organized crimes groups of those countries.) and the governments of China, Iran, France, Italy, Russia. From 2004 the main agenda was to outsmart the Americans, The Arab world, the Islamic world and have total control of all Somalia with sub-clans groups who call themselves autonomous regions-breakaway States and at the end have a Confederation of Somali States with names like Somaliland,Puntland,Jubbaland,Hiiraanland,Bay/Bakol land,Benadir land etc.In that way there is not anymore the Somali Republic but new states with new sovereignty and then the spoils would be divided between this international groups and Al-ittixad business Cartels who would control the economies of this new satellites states while the Ethiopians and IGAD will install leaders of their liking.
In the 80” when this quasi inhuman agenda was hatched the Regime of Menghiste needed to control Somalia by subdividing it in sub-clan based States. The two main leaders of the U.S.C- Manifesto group who said no to the Ethiopian hegemony were assassinated in Italy, masterminded by Somali Ittixad leaders’ members of the U.S.C and the Ethiopians, with the complicity of Italian mafia and the Italian intelligence services in April and July1990. The two were my late father Ali Mohamed Ossoble who was one time vice-president of The S.N.M and later president of the U.S.C Roma( 1989-1990) and DR. Ismail Giumale Ossoble who started the Manifeto group(1990). After
the assassination of these two leaders the U.S.C was taken over in Ethiopia-Nairobi by pro-Ethiopian groups and in Mogadishu by the All-Ittixad political movement members masquerading as U.S.C leaders. That is main reason instead of fighting against the Siad barre regime for regime change the U.S.C started a civil war and the total destruction of the State infrastructures in Mogadishu and all over Somalia. The Militia of the U.S.C in Mogadishu and the S.N.M( in the north) and S.S.D.F in (northeast) were looting and destroying every system connected with the Somali state and started as a policy to have Clan cased regions-areas.
The other policy of Al-Ittixad is to take over the economies of all regions of Somalia specially the Trade, Communication Hawilaad/money-remittances,the education systems starting from the madrasa to the universities. The policy of the Ethiopians to subdivide the Somalis in sub-clans groups which are fighting each other,have borders between themselves and ruled by Warlords/puppet leaders was made the main agenda. The ittixad Movement accepted this model agreed with the Ethiopian and conceal any accusation that they were controlling the political spheres of the society.

About the latest attacks in Mogadishu by Al-shabaab.Wait and see
I am a very emotional person when it cams to issues of Death and Life concerning the Somali people-citizens.Yesterday in Mogadishu was a carnage organized and executed by the terror group Al-Shabaab.There was two deadly attacks on the Somali Regional Courts offices,courthouses and officers and other one at the main road to the airport of Mogadishu. There was a difference of few hours between the two attacks.A total of 35 people including two Turks aid workers and women, have been killed.What I will write about is the reasons behind these attacks ,why they are happening now and what is the Grand-strategy of the Somali conflict.
First let me explain that the new government of President Hassan Shek has made a big difference for the Somali people-citizens from every walk of life and Clan- community. He has brought a Vision and Agenda for the governance,Unity of the Somali Federal Republic and on how the Somali people must govern themselves and decide their own Destiny.For the last 22 years the decisions on the future of the Somali Republic was decided in Djibouti,Addis-Abeba or Nairobi with the blessings of European,Arabs and American governments. The Ittixad business Cartels which is the latest version of Salafism-Organized crimes-Business Cartels combined was also part of this Grand-Strategic project by the regional powers.The Change in government brought by Hassan Shek is very dangerous for this regional powers and Al-Ittixad business cartels.Yes Al-Shabaab have done the attacks but Al-Shabaab has a tactical and strategic partner in the Al-ittixad business Cartels,Puppet leaders-Warlords linked to Ethiopia-IGAD, organized crimes groups.All this groups felt threatened by the good policies of the new government in Mogadishu..
For some people my analysis will came strange and farfetched but this is the reality of Somalia. What is at stake is OIL and Gas and as I have written before Salafist in the Ittixad Business cartels groups allied to AL-Shabaab,regional powers like Ethiopia-IGAD and Global powers like China,France and Iran are involved .In other words the attacks of Al-shabaab are helped and assisted by the Salafist in government and in business,organized crimes all linked to the Ethiopian intelligence.Why this type of alliances exsist in Somalia is the Ethiopian intelligences from the Minghiste times of the 80" to the Tigre regimes of today have found convenient for their own interest to ally themselves with the Salafist groups,puppet leaders-Warlords-Organized crimes groups-Elites.This was a strategy to out smart the Americans, Arabs which have only ideological ways to look at political and economical events.For the Chinese,Ethiopia-IGAD and Iran this kind of alliances are good if they will get the so-coveted Oil and Gas and remake the Colonial borders of the region while remaking Somalia.
The biggest Sin of the Hassan Shek government is have said no to this sinister Strategic Project in which the "Means justifies the End".. In other words a pact between Salafist be in Al-shabaab or Ittixad business Cartels-Organized crimes and Ethiopia-IGAD plus the China, Iran ,France groups for the Oil and Gas of Somalia.The Americans and the Arab, Muslim government like Turkey who really care about the coming back of Somalia must revisit their strategies and have a more robust involvement in the Somali affairs.Wait and see. .

The last time I wrote in my blog directly not reusing comments I think it was in February.. Usually I analyzed Somali issues whenever they become hot and bent on being.almost divisive These days we are on that period which I would call the time of Zero Sum Game. First of all let me re-explain that the conflict in Somalia started from 1991 and planned from the 80" by the Ittixad Political movement and the two regimes of Ethiopia aided by regional states was first to destroy Somalia and later to take its Oil and Gas by making a new Sovereign States on the Somali Republic territory who can Claim new political rights and economic rights. The last week the Somali PM went to Kismayo/Jubbaland region of Somalia where Militia-Clans groups trained by Ethiopia/Kenya and allied to Ethiopia/IGAD are bent to self-proclaim themselves the new rulers of the regions outside the Rule of the Somali Government.In-other words to proclaim sovereign themselves under the guise of Autonomy but for a future Confederation of Somali states.The PM who represented the Somali federal government told them what they are doing is not legitimate and only the government under the new Constitution could only make new administrations for the Regions. The Warlords--Salafist-Clans militia who are allied with Ethiopia/Kenya are bent to follow the Ethiopia-IGAD agenda to the extremes: a New State- Regions called Jubbaland which is vassal to Ethiopia and Kenya and have the "powers" to sell the Oil and Gas of the Regions.The PM went also this week to Gedo region and appointed a regional governor to out- maneuver the Agenda of the Ethiopia-IGAD group..Gedo is the main Region of Jubbaland.. In Somalia in this days we have two political projects going on : One made by the EthiopiaIGAD group to have Somalia subdivided in Confederate States so to have at least five new Sovereign States under the Hegemony of Ethiopia and IGAD .The other political project is by the Somali Government plans to have a devolved powers structure were the regions controls some of the resources and have their regional powers but in One Somali State called the Somali federal government.. The last week the Somali PM went to Kismayo/Jubbaland region of Somalia where Militia-Clans groups trained by Ethiopia/Kenya and allied to Ethiopia/IGAD are bent to self-proclaim themselves the new rulers of the regions outside the Rule of the Somali Government.In-other words to proclaim sovereign themselves under the guise of Autonomy but for a future Confederation of Somali states.The PM who represented the Somali federal government told them what they are doing is not legitimate and only the government under the new Constitution could only make new administrations for the Regions. The Warlords--Salafist-Clans militia who are allied with Ethiopia/Kenya are bent to follow the Ethiopia-IGAD agenda to the extremes: a New State- Regions called Jubbaland which is vassal to Ethiopia and Kenya and have the "powers" to sell the Oil and Gas of the Regions.The PM went also this week to Gedo region and appointed a regional governor to out- maneuver the Agenda of the Ethiopia-IGAD group..Gedo is the main Region of Jubbaland.. Tuesday(05/02/2013) was one of the darkest days for Somali "Legal
institutions". That morning the so called Somali criminal Court sitting
in Mogadishu ruled on the now infamous case of the "Somali journalist
and the raped woman"who were arrested and 'accused to have lied and made
to dishonor the State and its officers" .
This case was the first of its type for the last 22 years and from when the Somali courts have been reestablished in 2004 in Mogadishu and later in 2009. I mean a rape case brought to trial-what the accused person was alleging-and the journalist who interviewed her accused to lying and dishonoring the State.
I followed the case from my base in Nairobi and followed it in the BBC Somali and VOA Somali radio programmes plus those international stations like Al-Jazeera TV which is the most watched station by the Somalis together with the Somali TV stations.
This case got an international resonance which was in part done by the Somali journalists which one of their colleagues was in the docket and by some women organizations who were against violence on Women..The journalists were frustrate and angered by the continuous killings by Al-Shabaab and harassment/arrests by the state authorities.In this comment/analysis i will not get the merits of the case which are not important to this writing but on the " legal issues of which Laws were applied by the Legal operators like judges".
The biggest miscarriage of Justice,abuse of the law and false interpretation of the norms of the Somali legal system has happened in that day at the so-called Somali court.First there has not been any trial of any meaning on that day but the most"dangerous" act occurred when we arrived at the reading of the sentence by the so-called judge. The sentence was read using as a legal basis some of the Suras( verses) of the Holy Qur'an( at lest four Suras) and also quoting some articles of the Somali Penal Code( at least three articles without saying why he used them and the legal rationale behind it. The format of the sentence sanctioned by the Penal Procedural Code was all missing and all other important legal procedure which must be used.
When I first heard on the radio here I got amused by the audacity of these so- called judges to "Change" by the stroke of their pens the Laws of the Somali Legal systems in the books and its procedure.The Somali legal system is the Continental type-codified norms- which were promulgated in Codes and laws passed by Somali parliaments from the 60',70',80', and myself studied at the University.-Faculty of Law. The Holy Qur'an and the Islamic religion in general are the religion of our Nation-State as is sanctioned in the provisional Federal Constitution of Somalia art.2 C.(1) says"Islam is the Religion of the State" and C (2) says" No religion other than Islam can be propagated in the country" and in C (3) says"No law which is not complaint with the general principles of Shari'.ah can be enacted.". More to that in the same Constitution art 3 (1) says the Constitution of the federal Republic of Somali is based on the foundations of the Holy Qur'an and the Sunna of our Prophet Muhammad(PBUH) and protects the higher objectives of the Shariah and social Justice." in the same article 3 C.(3) says "The Constitution of the federal Republic of Somalia promotes Human Rights,The Rule of Law,general standards of International law,Justice etc.
What this judges were doing was not sanctioned in the Law,was not in our new Federal Constitution and was not in our penal system written or used for the last 52 years when the Somali Republic was legally established as a sovereign Nation -State. There is not any Law approved by the parliament or even a Decree law signed by the president or the Councils of Ministers which authorizes this kind of "Mixing i a Hybrid way Suras of the Holy Qur'an and the Somali Penal Code.
The Question which comes to mind is 'how they can do it"?Quite simple.The former President was a Salafist which did not believe in the Rule of the Law and the passing of laws even Islamic by the parliament to Change the Penal Code or any other Law.. Therefore from his days in power without the consent of the parliament or changing/amending of any Law the so-called Somali Courts started using what I call this "Hybrid system" of so-called sentencing and applicable law : Mixing of the codified laws and quoting some verses of the Holy Qur'an as basis for judgement.
This was a tactical legal maneuver in which the Salafist /Militant/Jihadist in the Somali government wonted to subvert the Legal system " without" any legal amendment" or law passed by the parliament.This was instigated,promoted also by the Al-Ittixad Business Cartels/Organized crimes groups which are a pseudo-salafist group allied with Ethiopia-IGAD who controls as a monopoly the Somali economy all over Somalia which the former President represented.
There are other Islamist groups in Somalia like the Ahlu-Sunna -Waljameeca which is a Sunni-Sufi affiliation which the majority of Somalis belong and the Al-Islaah groupings who are modeled like the Muslim Brotherhood. Both of this two Islamic groups approve the Somali legal system and its democratic principles written in the new constitution.
The other important factor which makes these judges so thick is they have been trained only on Islamic law for two or three years by so-called Colleges run by the Salafist Al-Ittixad business cartels and do not have any knowledge of the Somali legal system and in particular the Somali penal code,the Somali procedural code,the Somali constitution all related laws.
If we came particularly to this case to be atrial Judge you need to have a good knowledge of the procedural penal code-the norms which explains and rules how must be the procedure of the case including the evidence and the witnesses-and even the workings/acts of the Judge and the courts itself.This judges have never taken thst kind of courses and had not the scant knowledge of the legal system of the Somali Republic.
The lawyers themselves have the same training of the Judges and have a knowledge based only on Islamic law by the so-called colleges which have sprouted in Mogadishu and all over Somalia without any regulation and state control on the legal education they were giving.Just like any commercial shop you can open your own college and give a degree of Islamic studies/Sharia law to unaware young men which will call themselves lawyers and judges,public prosecutors in a matter of time after they have been employed by the Ministry of Justice.Maybe even some of the so-called lawyers,judges have never had any legal education including the Sharia Law but just Islamic studies in general.

I think first of all the Somali President ,prime minister and the speaker of the House must have a meeting with the Supreme court chief,the Ministry of Justice Minister and the appellate court chief Judges and tell in a clear way to change this new" legal model" in applying the Law in lower courts.Because even this groups now that what they are doing is not sanctioned by the Law. secondly those young men who have been made judges on the basis of clan quotas and do not have any legal training as the Law says they must be redeployed to other duties and their appointments revoked immediately.Also this mess of conducting trials and applying the law in the wrong way must be stopped immediately .And then the few judges who know the law including some of my former colleagues who are sitting in the supreme Court and appellate court to be redeployed at the district courts. To start a new salary system like those of the parliamentarians for judges,Prosecutors who have the needed knowledge of the Law(university degree from the Somali national university or equivalent) and give other incentives and the security protection needed. This are my suggestions in the short term and with immediate effect.
In the medium term we need a complete re-evaluation of what went wrong and how to repair it starting also for the planning for a School of law which even some of the these young men with the right degree and courses could be re-trained and refresher courses for the older lawyers and judges.But the most important is the reopening of the Faculties of Law and Business-management of the Somali national university.This must me done in the next two years.I know my Somali lecturers at the Somali national university are all unemployed and sitting idle in London,and other European,Canadian ,American cities.Why we cannot recall them and restart the legal education needed for our courts and our public and private institutions?
Last but not least the Ministry of Justice must be revamped specially the department of justice and all the those Salafist groups who are there for political reasons must be checked out.Also the department of Rule of Law and justice at the UNDP- Somalia must be revamped and everybody there for more that three years its contract must be rescinded because they are part of the problem.. They are the ones who were giving a salary to this Salafsit trained judges and were wasting the money of the international community .Wait and see

When I first heard on the radio here I got amused by the audacity of these so- called judges to "Change" by the stroke of their pens the Laws of the Somali Legal systems in the books and its procedure.The Somali legal system is the Continental type-codified norms- which were promulgated in Codes and laws passed by Somali parliaments from the 60',70',80', and myself studied at the University.-Faculty of Law. The Holy Qur'an and the Islamic religion in general are the religion of our Nation-State as is sanctioned in the provisional Federal Constitution of Somalia art.2 C.(1) says"Islam is the Religion of the State" and C (2) says" No religion other than Islam can be propagated in the country" and in C (3) says"No law which is not complaint with the general principles of Shari'.ah can be enacted.". More to that in the same Constitution art 3 (1) says the Constitution of the federal Republic of Somali is based on the foundations of the Holy Qur'an and the Sunna of our Prophet Muhammad(PBUH) and protects the higher objectives of the Shariah and social Justice." in the same article 3 C.(3) says "The Constitution of the federal Republic of Somalia promotes Human Rights,The Rule of Law,general standards of International law,Justice etc.
What this judges were doing was not sanctioned in the Law,was not in our new Federal Constitution and was not in our penal system written or used for the last 52 years when the Somali Republic was legally established as a sovereign Nation -State. There is not any Law approved by the parliament or even a Decree law signed by the president or the Concils of Ministers which authorizes this kind of "Mixing i a Hybrid way Suras of the Holy Qur'an and the Somali Penal Code.
The Question which comes to mind is 'how they can do it"?Quite simple.The former President was a Salafist which did not believe in the Rule of the Law and the passing of laws even Islamic by the parliament to Change the Penal Code or any other Law.. Therefore from his days in power without the consent of the parliament or changing/amending of any Law the so-called Somali Courts started using what I call this "Hybrid system" of so-called sentencing and applicable law : Mixing of the codified laws and quoting some verses of the Holy Qur'an as basis for judgement.
This was a tactical legal maneuver in which the Salafist /Militant/Jihadist in the Somali government wonted to subvert the Legal system " without" any legal amendment" or law passed by the parliament.This was instigated,promoted also by the Al-Ittixad Business Cartels/Organized crimes groups which are a pseudo-salafist group allied with Ethiopia-IGAD who controls as a monopoly the Somali economy all over Somalia which the former President represented.
There are other Islamist groups in Somalia like the Ahlu-Sunna -Waljameeca which is a Sunni-Sufi affiliation which the majority of Somalis belong and the Al-Islaah groupings who are modeled like the Muslim Brotherhood. Both of this two Islamic groups approve the Somali legal system and its democratic principles written in the new constitution.
The other important factor which makes these judges so thick is they have been trained only on Islamic law for two or three years by so-called Colleges run by the Salafist Al-Ittixad business cartels and do not have any knowledge of the Somali legal system and in particular the somali penal code,the somali procedural code,the Somali constitution all related laws.
If we came particularly to this case to be atrial Judge you need to have a good knowledge of the procedural penal code-the norms which explains and rules how must be the precedure of the case including the evidence and the witnesses-and even the workings/acts of the Judge and the courts itself.This judges have never taken thst kind of courses and had not the scant knowledge of the legal system of the Somali Republic.
The lawyers themselves have the same training of the Judges and have a knowledge based only on Islamic law by the so-called colleges which have sprouted in Mogadishu and all over Somalia without any regulation and state control on the legal education they were giving.Just like any commercial shop you can open your own college and give a degree of Islamic studies/Sharia law to unaware young men which will call themselves lawyers and judges,public prosecutors in a matter of time after they have been employed by the Ministry of Justice.Maybe even some of the so-called lawyers,judges have never had any legal education including the Sharia Law but just Islamic studies in general.
The reasons behind this so-called "Hybrid system" is another way to bring from the window acts which have not been done through the parliament and in thst way implement the political Agendas of the pseudo-Salafist Al-ittixad business cartels. The Al-Ittixad business cartels would like to use their" salafist interpretation of Islam as a political weapon" to subjucate the somali people-citizens and their undemocratic Agendas in the Political and Economic spheres of Somali society and state.This young men are ding what they have been told to do by this groups.
What I call the" Hybrid system" is not sanctioned by the new Somali federal constitution or any other Law of the Land of the Somali Republic.What are the solutions to this legal conundrum made by the Salafist?
I think first of all the Somali President ,prime minister and the speaker of the House must have a meeting with the Supreme court chief,the Ministry of Justice Minister and the appellate court chief Jugdes and tell in a clear way to change this new" legal model" in applying the Law in lower courts.Because even this groups now that what they are doing is not sanctioned by the Law. secondly those young men who have been made judges on the basis of clan quotas and do not have any legal training as the Law says they must be redeployed to other duties and their appointments revoked immediately.Also this mess of conducting trials and applying the law in the wrong way must be stopped immediately .And then the few judges who know the law including some of my former colleagues who are sitting in the supreme Court and appellate court to be redeployed at the district courts. To start a new salary system like those of the parliamentarians for judges,Prosecutors who have the needed knowledge of the Law(university degree from the Somali national university or equivalent) and give other incentives and the security protection needed. This are my suggestions in the short tem and with immediate effect.
In the medium term we need a complete re-evaluation of what went wrong and how to reapir it starting also for the planning for a School of law which even some of the these young men with the right degree and courses could be re-trained and refresher courses for the older lawyers and judges.But the most important is the reopening of the Faculties of Law and Business-management of the Somali national university.THis miust me done in the next two years.I know my somali lecturers at the Somali national university are all unenployed and sitting idle in London,and other European,Canadian ,American cities.Why we cannot recall them and restart the legal education needed for our courts and our public and private institutions?
Last but not least the Ministry of Justice must be revamped specially the department of justice and all the those Salafist groups who are there for political reasons must be checked out.Also the department of Rule of Law and justice at the UNDP- Somalia must be revamped and everybody there for more that three years its contract must be rescinded because they are part of the problem.. They are the ones who were giving a salary to this Salafsit trained judges and were wasting the money of the international community .Wait and see
This case was the first of its type for the last 22 years and from when the Somali courts have been reestablished in 2004 in Mogadishu and later in 2009. I mean a rape case brought to trial-what the accused person was alleging-and the journalist who interviewed her accused to lying and dishonoring the State.
I followed the case from my base in nairobi and followed it in the BBCSomali and VOASomali radio programmes plus those international stations like Al-Jazeera TV which is the most watched station by the Somalis together with the Somali TV stations.
This case got an international resonance which was in part done by the somali journalists which one of their colleagues was in the docket and by some women organizations who were against violence on Women..The journalists were frustrate and angered by the continuos killings by Al-Shabaab and harassament/arrests by the state authorities.In this comment/analysis i will not get the merits of the case which are not important to this writing but on the " legal issues of which Laws were applied by the Legal operators like judges".
The biggest miscarriage of Justice,abuse of the law and false interpretation of the norms of the Somali legal system has happened in that day at the so-called Somali court.First there has not been any trial of any meaning on that day but the most"dangerous" act occurred when we arrived at the reading of the sentence by the so-called judge. The sentence was read using as a legal basis some of the Suras( verses) of the Holy Quran( at lest four Suras) and also quoting some articles of the Somali Penal Code( at least three articles without saying why he used them and the legal rationale behind it. The format of the sentence sanctioned by the Penal Procedural Code was all missing and all other important legal procedure which must be used.

The Mayor of Garissa Town of Kenya went to visit the Somali region State of
Puntland.He had the invitation of Mr. Farole. This is all part of the
conspiracy to sub-divide the Somalis in Clans and sub-clans who carve
themselves parts of Somalia for themselves
and declare their right of self-determination.The only connection
between the citizens of Garissa and Puntland are they are Clan cousins
but they live under different State jurisdiction/sovereignty therefore
they represent the interest of two different States.The D.C of Garissa
represents the interests of the Kenyan government- to whom he took the
Oath of office- and that of Mr. Farole he represents the interests of
the Somali Republic- to whom he took the Oath of office- not of any
Clans groupings. This Politics of subdividing the Somalis in clans
groupings and in that way use their clan animosity is part of the
tactics of the Tigre regime of Ethiopia.They use Somali puppet leaders
,warlords,Alll-ittixad business cartels members and organized crimes
groups( this time they went extra-territorial) to foment that
clan-consciousness which is "the most dangerous obstacle' for the
reestablishment of the people-citizens-consciousness.The Tigre regime is
going viral in this Agenda to have Somali under their
hegemony/recolonized and they are telling some Sub-clans .Clans that
they will defend their interests against other Somali clans.This is one
of those Lies the Somali people-clans-citizens are fed. Ethiopia is the
First enemy of every Somali-clan or sub-Clan and any agenda they have is
against All Somalis whatever Clans they are from.I wrote before to rule
Ethiopia the Tigre Regime needs to rule Somalia.Why? To get the vast
reserves of Oil and Gas of the Somali region Of Ethiopia- without giving
the right share to the indigenous Somalis- the Tigre regime needs to
Rule Somalia and use its ports for the transhipment of that Oil and Gas.
The idea to have a separate state for Jubbaland-Kismayo- is part of
that conspiracy and will not help or is in the interests of any Somali

to re-establish a strong Army,Police force and security services which

to any honest Somalis who cares about the unity,sovereignty of the
Somali Republic. Secondly i would also praise what the U.K is doing for
Somalia.Here I would write what I have
heard on the news: that the British government is calling for a second
meeting in London for donors and the Somali government.I hope this time
the British government have came to understand all the" issues" of the
Somali conflict and why we have a "perpetual failed State" which have
been re-balkanized in mini-clan-enclaves-regions-states.An economy which
is run( all over Somalia) by a group of Business People who mixes
religion- business-organized crime and have their own foreign policies
when it comes to the future of the country.But the most dangerous thing
is Regional powers who do not wont peace and stability in Somalia but in
the same time "are part of the fight against the terror group
al-Shabaab"A civil society groups which have been sub-divided in clans
groups and even our beloved religion" Islam" is being used by regional
powers to subdivide the Somalis.I think before the meeting the British
government must consult with a small group of honest Somali technocrats
and intellectuals of every conceivable clan and Sub-clan and prepare a
short vision for the re-establishment of the Somali State institutions

scientific needs of the Somali Republic.It must be tripartite including
Somali academia mostly from diaspora and some at home,Bureaucrats and
representative of the Somali State.Plus the civil society groups

Secondly if we continue on this political mess of subdividing us our beloved Land will be taken over.Wait and see.

The Somali-Kenyan dispute on Jubbaland maybe solved.
The last three days may well augur well for the Somalis of the Somali Republic but it looks as usual the Tigre regime of Ethiopia have other ideas. Let me start that the Somali refugees and business community(from Somalia) who are one of the richest groups in Kenya had a very troublesome last three weeks.There were acts of terrorism in Eastleigh and the Kenya government fed up with that declared that Somali refugees must be repatriated without any agreement with the UNHCR.The arrival of the President of the Somali federal Republic Mr. Hassan Sheik and the subsequent rapprochement between the two countries( read the following article) have brought back the Somalis from an economic crisis and emigration/refugee crisis which was engulfing the mind and activities of the Somalis.The two government have decided to collaborate on various issues including the issues of refugees and other pressing issues like the stay of the Kenyan Armies in Somalia and the fight against Al-Shabaab etc.The most important is the issues of Kismayo ( Lower region) and I believe the Kenyans have came to realize the policies of IGAD and Ethiopia were counter-productive in the long run for the stability,peace and development of the region as a whole. Kenya is going to have its "own input" in the border region of Jubbaland but not as the Ethiopians wonted to have a vassal state in the Jubbaland region of Somalia.I hope things went as I am thinking and would like.The President of Somalia has thanked the Government of Kenya for their assistance and giving the Somalis the opportunity to prosper as business community in Kenya. The other issues I would write are about the new "game plan" of the Tigre Regime of Ethiopia and how I see the "the entourage" and some of the things the President has said here in Nairobi at a Lunch for the Business and Somali Elites here in Nairobi.
The president is a "good"person well mannered and with a clear vision for the future of the Somali Republic and how the peoples of the region and government interact.He already put in writings his ideas which are the "guiding' principles" of the policies of his government.But the problem in Somalia there is a gap between what he is saying and wants to achieve and the overall architecture of the institutions of the State in Somalia and the personnel heading them.I mean those people of his "entourage" who call themselves the security apparatus of the Somali Republic.First they do not have any military training and secondly they have been nominated by the former president by being as him trained in Sudan and good friends of Ethiopia. The are plenty of Somali officers which had good training at Siad Barre era governments which can do this jobs and are not tainted with human rights abuses.The other group of the entourage is what I call the "Ceel Macaan" Al-Ittixad Business cartels( Ceel Macaan is a port in north Mogadishu which was used by this groups for almost 20 years instead of the Mogadishu port).This group is mostly concerned of having the monopoly of the economy and control of the political system.They were allied with the I.C.U and together with the former president they became allied with the Ethiopians in 2009.From that time they also expanded their control on the political spheres and in the four years of the two Sheriffs reign( former president and former speaker) become the most powerful in the Somali elites.They have also links with the Chinese government and business community and they would like to control the Somali national resources like Oil and Gas for their own benefit.They are still in power and the president must find a method to tell them that the government is a product of the Will of the people and their individual and Wahabist-Salafist agendas cannot control the Somali national resources or in general the Somali Nation-hood or the National interest of the Somali Federal Republic.He must find the strategy to tell this business conglomerates who are against anything public that if they wont to survive and be part of the economic structure of the country they must change their agendas and be just one group of the overall economic and political spheres not the only one.Secondly they cannot have foreign policies which are against the Somali national interests.Period. The other thing is as usual they offer money to any government which came to power and in that way corrupt the system and have undue influence in the making and application of economic policies.This groups have never paid taxes of any type to any Somali government and by paying so- called charitable huge amounts of money to the government they avoid to have any tax or accountable system to know their finances and "have a "not failed state" which is part of the economic system.The other big story is the Ethiopians having failed in the diplomatic spheres against the Somali government when it came to the Sovereignty to administer the regions of Somalia they have reverted to the Old system of dividing the Somali puppet leaders.The former speaker of the parliament who every body knows is pro-Iranian,China-man and best puppet leader of Ethiopia is in this days with a group of so-called parliamentarian in Addis-Abeba to plan with the Ethiopians how to stop the plans of the new President and bring back the Old Agenda of sub-dividing the Somali Republic in vassal states.I think unless the West and the Islamic,Arab world tells Ethiopia that their meddling in the internal affairs of Somalia and treating Somalia their own backyard to be colonized I believe Somalis will never have peace and Stability and Al-Shabaab fight will be endagered.Wait and see.

History of the alliance between Ethiopia and All-Ittixad political movement.Wait and see.
Its quasi reasonable analysis of the Turkey role in Somalia. What I know is our friends Turkey one time has close contacts and business dealings Al-Ittixad business cartels which are allied with Ethiopia and Al-Shabaab. Somali politics
is very complicated for those which are new comers and at first-sight if you think in black and white you will never understand it. Myself who has being involved in it for a very long time as a human rights lawyer and activist and lately as a blogger it took me a very long time to understand it and came to know how the Islamist of Al-Ittixad business cartels could be allied with States like Ethiopia, China, Iran, and France. First was about the hegemony of Ethiopia of the Somali territories but it became from the 90’ about the Oil and Gas of Somalia. For this reasons atheist State like China and Islamist-radicals like All-Ittixad business cartels are allied. The masterminds of this alliance were Somali elites warlords-drug-barons linked to All-Ittixad political movement and in the same time members of the so-called movement-oppositions based in Ethiopia in the late
80".Later during the first conference for Somalia to reestablish a transitional government in Nairobi from 2004 the alliances was remade
and strengthened including some”‘Ruling elites" of IGAD( Ethiopia,Uganda,Kenya,Tanzania,Sudan, Professional Elites in politics, business, professionals in media-print and TV and Organized crimes groups of those countries.) and the governments of China, Iran, France, Italy, Russia. From 2004 the main agenda was to outsmart the Americans, The Arab world, the Islamic world and have total control of all Somalia with sub-clans groups who call themselves autonomous regions-breakaway States and at the end have a Confederation of Somali States with names like Somaliland,Puntland,Jubbaland,Hiiraanland,Bay/Bakol land,Benadir land etc.In that way there is not anymore the Somali Republic but new states with new sovereignty and then the spoils would be divided between this international groups and Al-ittixad business Cartels who would control the economies of this new satellites states while the Ethiopians and IGAD will install leaders of their liking.
In the 80” when this quasi inhuman agenda was hatched the Regime of Menghiste needed to control Somalia by subdividing it in sub-clan based States. The two main leaders of the U.S.C- Manifesto group who said no to the Ethiopian hegemony were assassinated in Italy, masterminded by Somali Ittixad leaders’ members of the U.S.C and the Ethiopians, with the complicity of Italian mafia and the Italian intelligence services in April and July1990. The two were my late father Ali Mohamed Ossoble who was one time vice-president of The S.N.M(1984-1987) and later president of the U.S.C Roma( 1989-1990) and DR. Ismail Giumale Ossoble who started the Manifesto group(1990). After
the assassination of these two leaders the U.S.C was taken over in Ethiopia-Nairobi by pro-Ethiopian groups and in Mogadishu by the All-Ittixad political movement members masquerading as U.S.C leaders. That is main reason instead of fighting against the Siad Barre regime for" regime change" the U.S.C started a civil war and the total destruction of the State infrastructures in Mogadishu and all over Somalia. The Militia of the U.S.C in Mogadishu and the S.N.M( in the north) and S.S.D.F in (northeast) were looting and destroying every system connected with the Somali state and started as a policy to have sub-Clan Based regions-areas.
The other policy of Al-Ittixad is to take over the economies of all regions of Somalia specially the Trade, Communication Hawilaad/money-remittances,the education systems starting from the madrasa to the universities. The policy of the Ethiopians to subdivide the Somalis in sub-clans groups which are fighting each other,have borders between themselves and ruled by Warlords/puppet leaders was made the main agenda. The ittixad Movement accepted this model agreed with the Ethiopian and conceal any accusation that they were controlling the political spheres in all regions and central government.
